What is the height of the bear in a sitting position?

About 8 to 10 inches at most. It is in a sitting position. To get the 13 inches you would have to grab it by the ears and pull it's legs. Ouch! Bears don't like that.It was a gift so I no longer have it to measure. Very cute. Most Gund products are very high quality.

Is this a safe gift for a 7 month old baby?

I would feel comfortable with a 7 month old or younger. Their are no parts than can be pulled off. Everyone is sewn on like a patch for eyes. No buttons.

Is this teddy bear in a permanent sitting position or can you be able to move its legs out?

He's not in a permanent sitting position. He is very flexible.
